Before launching a brand: company name and trademark checks

Business tax guide: Before launching a brand: company name and trademark checks
Quick answer: A company name, domain and trademark answer different questions. Before committing to packaging, identify the proposed mark, actual owner and goods or services, then investigate conflicting rights and the appropriate filing route.

Source check: 15 September 2026. Practical preparation guidance for Pakistan. Examples are illustrative; any rate or filing period must match your own transaction.

Four checks for one proposed name

You may be able to buy a domain or create a social account even when using the name could conflict with someone else’s brand. Keep a record of each check and what it establishes. A screenshot of an available username is not a trademark clearance opinion.

Four checks for one proposed name
CheckWhat you are checking
Company nameThe name proposed for the legal entity through SECP’s process.
TrademarkThe proposed sign, relevant goods/services and potentially conflicting rights.
DomainWhether you can obtain and control a particular web address.
Social accountWhether a platform username is available under that platform’s rules.

WIPO explains trademarks as signs that distinguish goods or services. Pakistan’s Trade Marks Ordinance is available through WIPO Lex. These are separate from the company incorporation process described in SECP’s FAQ.

Prepare a useful search brief

  1. Write the exact proposed word, alternative spellings and any Urdu or other-language version you intend to use.
  2. Save the proposed logo separately from the word name; identify whether both need assessment.
  3. List the actual goods or services in ordinary language, including planned extensions.
  4. Identify the intended owner and explain whether it is an individual or an existing entity.
  5. Collect any prior-use evidence and details of similar names you have already found.

Use this brief to discuss classification and the appropriate search with IPO-Pakistan or a qualified adviser. A business can sell different types of goods or services; do not assume one broad label such as “online business” explains everything the application needs to cover.

Example: one store, several activities

Imagine a new shop selling its own perfume brand, reselling third-party watches and operating an online retail service. Its proposed sign and intended use need to be explained accurately. Do not pick a trademark class solely because another online store used it, or assume a filing for one product automatically covers every future activity.

Before ordering printed bottles, labels or signage, keep the expensive commitment reversible while the search and ownership decisions are unresolved. Record the version of the logo that was assessed. A later redesign can raise a different question from the word mark originally discussed.

Questions to ask before paying a filing fee

  • Which mark and which owner will appear in the application?
  • Which goods/services are included, and what is outside the scope?
  • What search was performed and what limitations remain?
  • Does the quotation separate official fees, search work, filing assistance and later responses?
  • How will I receive the filing acknowledgement and future correspondence?

A search result is an input to a decision, not a guarantee of registration or freedom from disputes. Where a similar name exists, ask for an assessment of the actual goods, use and rights before proceeding. Changing one letter is not a reliable clearance strategy.

Keep control of your brand records

Retain the brief, search findings, agreed specification, filed version, payment evidence and application reference. Keep domain and platform recovery details under the business’s control. The named applicant and the person managing the account should understand their different roles.

You can prepare the brief and perform preliminary market checks yourself. Seek professional assistance for similar marks, shared ownership, multiple activities, prior use by another party or an objection. Ask for the current official IPO procedure and fees at the time of filing; no unverified fee or approval timeline is quoted here.

When to request help

Clear the name across four different systems

Company-name availability, trademark registrability, domain availability and social-handle availability answer different questions. An SECP reservation does not grant trademark rights, while owning a domain does not authorize use of a confusingly similar brand. Search exact wording, phonetic variants, translations and the key product or service classes before committing to signage or packaging.

Record the date, database, search terms and similar marks reviewed. Escalate close matches based on visual, sound and commercial overlap, not only identical spelling. If clearance is uncertain, compare the cost of a focused trademark opinion with the cost of rebranding after launch. Preserve evidence of your chosen mark's first genuine use and keep the legal owner consistent across applications and contracts.

Prepare my brand clearance brief

Tell us the proposed name, products or services, intended owner and whether the brand is already in use. Start with a short summary. Do not send passwords, PINs or one-time codes. Ask for the scope and professional fee before commissioning work.

Questions people also ask

Does company registration automatically register the trademark?

No. Treat entity incorporation and trademark protection as separate processes and keep their records separately.

Can I rely only on a domain availability check?

No. Domain availability does not resolve potentially conflicting trademark rights or the scope of a trademark application.
