Quick answer: Applicants with no SSN or ITIN cannot use the online EIN tool. They complete Form SS-4, enter Foreign on line 7b, and apply by fax, post or the international telephone line. The EIN is free and no agent is required.

The EIN is the step where most non-resident founders stall. Formation takes days. The bank account is a known obstacle. In between sits a federal tax identification number that the IRS will issue to you without difficulty, on a form that has not changed much in decades, through a channel that most people never find because the internet keeps pointing them at a website that is closed to them.

This guide walks Form SS-4 line by line for a founder outside the United States with no Social Security Number, gives the exact cover sheet and call script that work, and lists the errors that cause delay.

The one-line version. If you have no SSN and no ITIN, the online application is closed to you. Complete Form SS-4, write Foreign on line 7b, and submit it by fax or by telephone on the international line. The EIN is free and no third party is required.

What an EIN is, and what it is not

Two Code sections explain why this apparently administrative step carries real exposure. Section 6109 of the Internal Revenue Code requires a taxpayer identifying number on returns and statements, which is what makes the EIN a prerequisite rather than a convenience. And for a foreign-owned single-member LLC, Regulations section 301.7701-2(c)(2)(vi) treats the entity as a corporation for the limited purposes of section 6038A, creating an annual Form 5472 obligation attached to a pro forma Form 1120 — which cannot be filed at all without the EIN.

The cost of getting the sequence wrong is specific. The EIN itself is free: the IRS charges nothing for it, and the $150 to $400 commonly quoted online is a third party's fee for filing a one-page form on your behalf, not a government charge. The penalty for the return it enables is $25,000 per form per year under section 6038A, with a further $25,000 for each 30-day period the failure continues after 90 days from IRS notice, and no ceiling. A foreign owner who postpones the EIN because "the LLC has no income" has postponed a filing whose penalty is uncapped and whose tax is nil.

An EIN is a nine-digit federal identification number for a business entity, written 12-3456789. Think of it as the entity equivalent of an NTN.

That last point drives the sequence. You cannot apply for an EIN for a company that has not been formed. Formation first, then EIN, then bank. These steps do not overlap.

Which to pick from Pakistan. Fax is the workhorse — you get a written trail and a returned confirmation. The telephone route is faster when it works, but it means holding a line to the United States inside a 6:00am-to-11:00pm Eastern window, which is roughly 3:00pm to 8:00am Pakistan time, with a form completed in front of you because the officer reads it back field by field. Prepare the SS-4 either way. Verify the current fax number in the live Instructions for Form SS-4 immediately before sending, because these numbers change without notice.

The single most important field. Line 7b. Founders who leave it blank get the form returned; founders who invent a number create a mismatch that surfaces at the bank; founders who write "Foreign" get an EIN. Where the responsible party has no SSN or ITIN, that is the entry the instructions contemplate.

The fax cover sheet that works

A fax with no cover sheet, no return number and no context is the version that goes missing. Use this structure.

Keep the transmission confirmation. It is the only evidence of when you applied, and it is what you will quote if you have to chase.

If you use the telephone route

The officer works through the SS-4 in order and enters your answers directly. Have the completed form, the formation certificate and a pen in front of you, because the EIN is often read out during the call and you write it on the form yourself.

What arrives, and what to do with it

The confirmation is Notice CP 575. It is issued once, it is not reissued, and banks and payment platforms ask for it constantly. Save a scan in at least two places the day it arrives.

If it is lost, the replacement is Letter 147C, which confirms the same number and is accepted in place of the CP 575 by essentially every bank and processor. It is requested from the IRS rather than downloaded.

What the EIN unlocks — and what it starts. With the EIN you can open the bank account, activate Stripe or PayPal, and be identified on any US filing. It also makes your annual information return practical to file. A foreign-owned single-member LLC generally has to file Form 5472 with a pro forma Form 1120 every year, and that filing needs the EIN. Getting the number is not the end of the compliance sequence; it is the point where it starts.

Do I need an ITIN before I can get an EIN?

No, and this myth costs people months. An EIN identifies a business entity; an ITIN identifies an individual. Where the responsible party has neither an SSN nor an ITIN, the SS-4 instructions allow the entry "Foreign" on line 7b and the application proceeds normally. You would apply for an ITIN separately, and only if you personally have a US individual filing to make.

Can I really not use the online EIN application?

Not if you have no SSN or ITIN. The online tool validates a US taxpayer number for the responsible party and stops without one. Any service advertising an "EIN in minutes" for a founder with no US taxpayer number is either using someone else as the responsible party, which is not permitted, or is quietly submitting a fax and describing it optimistically.

Can I put my formation agent down as the responsible party?

No. The responsible party must be a natural person who actually controls or owns the entity, not a nominee, a company, or the agent who filed your paperwork. Naming a nominee is expressly outside the rules and creates a record that is difficult to correct later. If you own the LLC, you are the responsible party even though you have never set foot in the United States.

I lost my EIN letter. Can I get another one?

You cannot get a second CP 575 — it is issued once. What you can get is a Letter 147C, which confirms the same number and is accepted by banks and payment platforms in its place. It is requested from the IRS business line, and for an entity with no US phone presence it is usually easiest to have an authorised representative request it.

Does having an EIN mean my LLC now owes US tax?

No. An EIN is an identifier, in the same way an NTN is in Pakistan. It creates no tax by itself. What it does create is visibility and the practical ability to file, so it usually arrives at the same time as the obligation to file an information return — which is a different thing from owing tax.
